How to Shield Your Estate from HMRC’s New Agenda

presented Live By Mike Pugh From MP Estate Planning UK.

Here's What We're Going To Cover:

  • How to Beat Rayner's £4bn Tax Raid using the same AIM and unlisted share strategies before they're completely abolished, so you keep more of your business wealth in the family.

  • The "Intestacy Trap" Escape Plan that prevents your estate from becoming one of the 51,140 families fighting in court, so your wishes are honored not government rules.

  • Probate-Proof Your Estate in Under 30 Days using legal structures that bypass the court delays now taking over a year, so your family gets immediate access to what you've built.

  • Shield Your Property from Care Fee Raids before the next budget changes the rules, so your home stays in your family instead of funding the NHS crisis.

  • The "Lifetime Allowance Defense" that protects your pension wealth from Reeves' reinstatement plans, so your retirement savings don't get capped and taxed.

  • Stop HMRC's "Unlisted Shares Grab" using legitimate business structures before the £1bn tax raid hits, so your company value stays with your heirs.

  • Emergency Estate Planning for the New Tax Regime that works even if you've done nothing before, so you can act before it's too late to protect your legacy.

Frequently Asked Questions

How do your estate planning services help reduce my inheritance tax liability?

Our expert estate planners create custom trusts and tax-saving strategies tailored to your unique situation. By placing assets in a trust, we help reduce or even eliminate your inheritance tax liability, ensuring more of your wealth is passed on to your loved ones.

What makes your trust services different from other providers?

We offer a personalized approach to trust creation, making sure your plan is designed specifically for your family dynamics, financial goals, and legal protection needs. Our advisors work closely with you to ensure the trust is flexible, tax-efficient, and aligned with your long-term vision.

Can you help protect my home from care fees?

Yes, one of our specialised services includes setting up property protection trusts to ensure your home is safeguarded from being used to pay for long-term care fees. Our team will guide you through the options to ensure your family’s home is secure.

Do you offer advice on protecting rental properties and other investments?

Yes, our estate planning services cover rental properties and other investments. We offer strategies for mitigating income tax and capital gains tax on these assets, while ensuring they are protected from legal claims or financial liabilities.

What are the costs of your estate planning services?

Our services range in price depending on the complexity of your estate and the types of trusts or strategies needed. Typically, our estate plans start at £3,000 to £5,000, but we provide full transparency upfront. During your consultation, we’ll give you a clear breakdown of costs with no hidden fees. The consultation is free of charge.

What’s the difference between a will and a trust?

A will outlines your wishes for asset distribution after death and goes through probate, while a trust holds your assets during your lifetime and can help avoid probate. Trusts offer more control over asset distribution and protection from taxes and legal claims.

Will I still have control over my assets if they are in a trust?

Yes, as the trustee or settlor, you retain control over how the trust is managed. You can make changes to beneficiaries or instructions while you’re alive and still have mental capacity, depending on the type of trust you set up.

What happens if I sell a property that’s in a trust?

If you sell a property held in a trust, the sale proceeds usually stay within the trust. However, there may be capital gains tax implications, which can sometimes be deferred or reduced using tax relief options like holdover relief.

Can I make changes to my trust after it’s set up?

Yes, if you set up a revocable trust, you can make changes, add or remove beneficiaries, and amend terms during your lifetime. However, irrevocable trusts are more difficult to change, offering more asset protection but less flexibility.

How long does a trust last?

Trusts typically last up to 125 years, depending on the type of trust and legal structures in place. During this time, trustees will manage the assets based on your instructions, even after your death.

"Also helped protect against care fees"

Back in 2019, our Dad put his home into an Asset Protection Plus Trust - and we were slightly nervous as it cost several thousand pounds.

Dad wanted to protect his home from Inheritance Tax and a possible divorce among his children.

Fast forward 4 years and unfortunately my Dad has had to go into care. We've now dealt with the local authority and are very pleased to tell you the house is not part of the financial equation!

Dad originally put the house into Trust because he needed to hold onto his tax reliefs and was worried one of us would get a divorce.

So imagine our surprise and delight when we realized it has also helped protect against care fees!

It’s worth mentioning, that at that time Mike said that he would be there to answer questions when the time arrives. And to his credit, I just finished a 30-minute phone call with Mike - updating my understanding about the Trust.

It's hard to find good people these days. I highly recommend Mike to anyone reading this review.

On behalf of our whole family,

Thank you very much, Karen.
