What’s the difference between a will and a trust?

A will outlines your wishes for asset distribution after death and goes through probate, while a trust holds your assets during your lifetime and can help avoid probate. Trusts offer more control over asset distribution and protection from taxes and legal claims.

Will I still have control over my assets if they are in a trust?

Yes, as the trustee or settlor, you retain control over how the trust is managed. You can make changes to beneficiaries or instructions while you’re alive and still have mental capacity, depending on the type of trust you set up.

What happens if I sell a property that’s in a trust?

If you sell a property held in trust, the tax treatment depends on whether the property is a main residence or a secondary property, and also on how it entered the trust.

For a main residence, if the trust qualifies for Principal Private Residence Relief—typically because the settlor or a beneficiary has lived in the property as their main home—then no Capital Gains Tax (CGT) is due on the sale.

For a secondary property, such as a buy-to-let or investment property, Holdover Relief can often be claimed at the time the property is transferred into the trust. This means no CGT is payable when the property enters the trust. Instead, the trust inherits the original base cost of the property, effectively deferring the gain until the property is eventually sold.

Can I make changes to my trust after it’s set up?

Yes, if you set up a revocable trust, you can make changes, add or remove beneficiaries, and amend terms during your lifetime. However, irrevocable trusts are more difficult to change, offering more asset protection but less flexibility.

How long does a trust last?

Trusts typically last up to 125 years, depending on the type of trust and legal structures in place. During this time, trustees will manage the assets based on your instructions, even after your death.

Back in 2019, our Dad put his home into an Asset Protection Plus Trust - and we were slightly nervous as it cost several thousand pounds.

Dad wanted to protect his home from Inheritance Tax and a possible divorce among his children.

Fast forward 4 years and unfortunately my Dad has had to go into care. We've now dealt with the local authority and are very pleased to tell you the house is not part of the financial equation!

Dad originally put the house into Trust because he needed to hold onto his tax reliefs and was worried one of us would get a divorce.
